TERMS OF SERVICE

These terms and conditions apply to Services provided by Kits Bridal (Khyati’s Bridal Studio), business registered in Nairobi – Kenya.

For purchases via our website, by clicking on button marked “I accept the Terms of Service and Privacy Policy” you agree to the terms of this agreement which will bind you.

Please read these terms carefully before purchase the service. These terms tell you who we are, how we will provide products & service to you on how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these Terms & Conditions (or that they require any changes), please contact us by email to khyati@kitsbridal.com so as to advise us of the issue.

If you do not agree to these terms and conditions, you must cease to continue to purchase any Services from us.

1. DEFINITIONS

“Fees” means the fees paid by you to Kits Bridal (Khyati’s Bridal Studio) for the Online Subscription for monthly or yearly plan.

“Online class” means the delivery by us of an online video tutorial to which you learn course remotely.

“Services” means the provision of the Online tutorials purchased by you through the Website.

“Subscription” refers to a right to use the applicable portion of the Website as a Subscriber under a paid subscription.

“Subscriber” also referred to as “Member” refers to an individual/ entity/ organization/ institution that has the right to access the Subscription Website via a Subscription Fee (Paid Subscription).

“Subscription period” means the period of time that a Subscriber may utilize the applicable portion of the Website.

“Subscription Website” means the applicable portion of the Website that is available only to a Subscriber.

“Website” means https://kitsbridal.com

“You” means the individual purchasing the Services.

2. THE SERVICES

2.1       A description of the Services together with the subscription plans are available on our Website.  We will provide the Services with reasonable care and skill.

2.2       We reserve the right to vary or withdraw any of the Services described on the Website without notice.

2.3       We expect you to confirm that the Services you are purchasing will meet your needs.  We do not make any guarantee to you that you will obtain a particular result, professional qualification or employment opportunity from your purchase and completion of any of the Services.

3. ORDERING SERVICES

Purchasing Services via the Website

3.1       In order to purchase any of the Services online you must register for an account with us via the Website.  If you already have an account with us, you can log into your account using your user name and password.

3.2       Subscriptions once purchased either for monthly or for yearly shall not be refunded or may not be transferred to any third-parties.

3.3       We only provide online / distance learning theory training with audio-videos/text/images materials. Further practical training and assessment may be required and / or is advised before engaging with clients so as to gain appropriate experience and expertise allowing competent practice. We will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

4. PRICE AND PAYMENT

4.1       The Fees for the Services shall be as set out on the Website.

4.2       Fees for the Service selected by you on the Website shall be debited from your credit / debit card at the time of purchase.

4.3       Any fees charged by your debit or credit card provider in connection with your purchase of Services are for your own account and Kits Bridal (Khyati’s Bridal Studio) shall not be responsible for these.

4.4       You shall be responsible for all costs you incur in connection with your access onto any Online Course.

4.5       You must make an advance payment of the specified subscription which is either monthly or yearly of the price of the services. Upon payment you shall be automatically granted access to view the online videos.

4.6       We reserve the right to amend course prices or run promotions at any time, without prior notice. Once a booking is made, the price paid is final and no price difference can be refunded in the event of a later course price reduction.

4.7       Fees are non-refundable and non-transferable.

5. HOW WE MAY USE YOUR PERSONAL INFORMATION

5.1       We will only use your personal information pursuant to the provisions set out in our Privacy Policy.

6. OTHER IMPORTANT TERMS

6.1       This contract is between you and Kits Bridal (Khyati’s Bridal Studio). No other person shall have any rights to enforce any of its terms. Neither of us will need to get the agreement of any other person in order to end the contract or make any changes to these terms.

6.2       You must be at least 16 years of age to use our website; by using our website or agreeing to these terms and conditions, you warrant and represent to us that you are at least 16 years of age.

7. DISCOUNT & COUPON CODES

7.1       We may from time to time offer promotional discount codes which may apply in respect of any, or certain specified, purchases made though this Website. The conditions of use relating to any discount code will be specified at the time of issue.

7.2       These T&Cs relate to all Khyati’s Bridal Studio promotions, competitions and discount codes (unless otherwise stated).

7.3       The code must be applied at checkout after the purchaser has registered or logged in to their account. Only one promotion/coupon code can be used per order per member. The discount code cannot be exchanged for cash or refund.

8. WEBSITE AVAILABILITY

8.1       Subscriber understand that the traffic of data through the Internet may cause delays during the download of information from the Website and accordingly, it shall not hold the Kits Bridal (Khyati’s Bridal Studio) liable for delays that are ordinary in the course of Internet use.

8.2       Subscriber further acknowledges and accepts that the Website will not be available on a continual twenty-four-hour basis due to such delays, or delays caused by the Company’s upgrading, modification, or standard maintenance of the Website.

9. TERMINATION

9.1     Subscription – Monthly and yearly subscription will expire 30 days and 365 days respectively after initial subscription or renewal. Hence, after subscription expiry the member will no longer be able to access the paid subscription content until the subscriber will renew the subscription in order to continue viewing our online content.

10.2     Kits Bridal (Khyati’s Bridal Studio) reserves the right to suspend access to their subscription for breach or suspected breach for these terms of services.

10. INTELLECTUAL PROPERTY

10.1     All Intellectual Property Rights in the Course Materials, Online Courses and the speeches made remain intellectual property of Kits Bridal (Khyati’s Bridal Studio).

10.2     You are not authorized to:

a) Copy, modify, reproduce, re-publish, sub-licence, sell, upload, broadcast, post, transmit or distribute any of the Course Materials without prior written permission.

b) Record on video or audio tape, by any means the Online classes.

c) Share your username & password with third parties as the service provided by us are personal to you and cannot be transferred or shared.

Breach of clause 10.2 will result in termination of the terms of service and hence, the service including cancellation of your registration and online access.

11. INFORMATION ABOUT US AND HOW TO CONTACT US

11.1     If we have to contact you we will do so by telephone, or by writing to you at the email address or postal address you provided to us in your order.

11.2     When we use the words “writing” or “written” in these terms, this includes emails.
